FDA Releases Draft Menu Labeling Guidance

The Food and Drug Administration (FDA) released a draft guidance document entitled, "Menu Labeling: Supplemental Guidance for Industry." The draft guidance addresses concerns regarding the implementation of nutrition labeling requirements for foods sold in certain restaurants and retail food establishments covered by the December 1, 2014, menu labeling final rule. It also includes expanded and new interpretations of policy and identifies areas where FDA intends to be more flexible in its approach. The draft guidance describes criteria for distinguishing between menus and other information presented to consumers; details methods for providing calorie disclosure information, including signage for self-service foods; and explains compliance and enforcement requirements; among other topics. FDA is accepting public comments on the draft guidance through January 8, 2018.
