Coalition for Fair Port Practices Urges Action on Detention-Demurrage FMC Petition

The Coalition for Fair Port Practices, to which the Meat Institute and the U.S. Hide, Skin and Leather Association belong, is urging member companies to support its petition for rulemaking before the Federal Maritime Commission (FMC) regarding detention and demurrage practices for cargo moving through the nation's ports. The letter specifically requests that FMC adopt a formal rulemaking to limit the shipping lines' ability to charge penalty fees when circumstances outside a company's control make it logistically impossible to pick up or drop off containers within the allotted time period. The letter details examples of incidents during which carriers and terminals should not assess demurrage or detention charges, including instances that involve inclement weather, labor contract negotiations and port congestion, among other disruptions.
