FSIS Provides Update on PHOs in Meat Products

The Food Safety and Inspection Service (FSIS) announced in Notice 31-18 the agency will exercise enforcement discretion in applying a 2015 declaratory order issued by the Food and Drug Administration (FDA) affirming partially hydrogenated oils (PHOs) are no longer generally recognized as safe (GRAS) in meat, poultry and egg products. FDA, in May, extended the compliance date for certain uses of PHOs in foods, and denied a food additive petition from the Grocery Manufacturers Association (GMA) requesting approval for certain limited uses of PHOs as carriers for color additives and flavoring agents.

FSIS Notice 31-18 details key compliance information pertaining to the PHO regulation. The notice states meat, poultry and egg products manufactured or distributed in commerce prior to June 18, 2018, containing PHOs not used for purposes listed in GMA’s petition may remain in commerce after that date. Establishments producing meat, poultry and egg products containing PHOs, used in a manner not addressed in the petition, must stop introducing PHOs into products by June 18, 2018, according to the notice. Meat, poultry and egg products manufactured or distributed in commerce prior to June 18, 2019, containing PHOs used as described in the petition, however, may remain in commerce after that date.
