DOL Rescinds Fair Pay and Safe Workplaces Executive Order

The Department of Labor (DOL) rescinded its guidance on Executive Order 13673, Fair Pay and Safe Workplaces. President Trump in March signed Public Law No. 115-11, a resolution of disapproval of the rule, which revoked the paycheck transparency component of the regulations that took effect on January 1, 2017. The resolution also permanently nullified the rule's labor violation reporting and arbitration restriction components, which were preliminarily enjoined by the U.S. District Court for the Eastern District of Texas before their effective date last October. In addition, President Trump issued Executive Order 13782 invalidating Executive Order 13673. DOL is, therefore, withdrawing its Fair Pay and Safe Workplaces guidance to comply with the Congressional Joint Resolution of Disapproval and Executive Order 13782. The Department of Defense, General Services Administration and National Aeronautics and Space Administration also published guidance rescinding a final rule amending the Federal Acquisition Regulation to implement the Fair Pay and Safe Workplaces Executive Order.
