President Trump Signs Resolution Invalidating OSHA Volks Rule

President Donald Trump last week signed H.J. Resolution 83 finalizing the Congressional Review Act (CRA) process to nullify an Occupational Safety and Health Administration's (OSHA) rule, "Clarification of Employer's Continuing Obligation to Make and Maintain Accurate Records of Each Recordable Injury and Illness," commonly referred to as the Volks' rule. OSHA can no longer issue citations for record keeping violations that occurred past a six-month period and because the rule was invalidated through the CRA process, OSHA is prohibited from issuing a substantially similar rule. Employers are still required to maintain OSHA 300 logs for a five-year period and must continue to update the forms as new or additional information is acquired.
