FSIS Issues Nutrition Facts Label Compliance

The Food Safety and Inspection Service (FSIS) issued an advance copy of a Federal Register notice allowing establishments to use the Food and Drug Administration's (FDA) revised Nutrition Facts label while FSIS undergoes the rulemaking process to update the Nutrition Facts label format for meat and poultry products. Provided the information on the labels is truthful and not misleading, meat and poultry companies that use the FDA label format will be in compliance with FSIS standards.

Companies that intend to use FDA's Nutrition Facts label format are required to submit at least one label sketch in that format to FSIS's Labeling and Program Delivery Staff (LPDS). A parent company for a corporation may submit only one label application for a product produced in other establishments that are owned by the corporation. Subsequent similar labels that use FDA's Nutrition Facts format for other products can be generically approved.

When FSIS publishes a final rule updating the Nutrition Facts label for meat and poultry products, companies will be required to comply with the final rule by the effective date and will no longer be able to use the FDA format if it is different from the FSIS format. Comments will be accepted for 30 days after the notice is published in the Federal Register.
