EPA and Army Corps Withdraw Agricultural Conservation Exemptions to WOTUS Rule

The U.S. Environmental Protection Agency (EPA) and the Army Corps of Engineers issued a memorandum of understanding withdrawing the list of agricultural conservation practices that would be exempt under the proposed Waters of the United States (WOTUS) rule, following significant objection from farming groups. The interpretive rule, which was released as a final rule on March 24, 2014, along with the proposed WOTUS rule, listed 56 conservation practices that would have been exempt from the Clean Water Act (CWA) requirements. The memorandum does not specifically address the broader proposed WOTUS rule that would expand CWA jurisdiction.
