AMI and NAMA Submit Comments in Opposition to EPA Waters of the U.S. Proposed Rule

In comments to the EPA and U.S. Army Corps of Engineers (Corps), AMI and the North American Meat Association (NAMA) laid out their opposition to the proposed rule that would broaden the definition of the Waters of the U.S. (WOTUS). AMI and NAMA urged EPA and the Corps to withdraw the rule.

Despite the agencies' assertion that the rule has a number of benefits related to reducing confusion about Clean Water Act (CWA) protection and clarifying the type of waters covered by the CWA, AMI and NAMA argue it would be an unjustified expansion of the CWA jurisdiction beyond the limits established by Congress and affirmed by the courts, and create more uncertainty and confusion for entities subject to CWA regulation, and those that are not. AMI and NAMA also joined with more than 340 other associations and the U.S. Chamber of Commerce in a separate filing opposing the proposed rule.
